Administrative Barriers in the Regions
The predominant practice of analysing the required actions (reforms) in Russia
to lower administrative barriers for entrepreneurship is focused mainly on the
analysis of the federal legislation and federal authorities' actions in this section.
Firstly, the prepared proposals and recommendations based on this analysis are
also, related to the federal level. At the same time, the assessment of the current
situation at the regional and municipal levels is expedient as beneficial as the
detection of successful actions by the regional and municipal authorities in this
section. This is due to the number of factors and includes:
- considerable differences in the management environment, arising in the
various regions of the country, which emphasise the necessity to take into account
regional specifics whilst designing actions aimed reducing the number of administrative
barriers in the development of entrepreneurship;
- powers of the regional and municipal authorities stipulated in the federal
legislation granted to independently introduce and regulate a number of administrative
procedures;
- differences in applying various norms and regulations set out in the federal
legislation and monitoring the nature and order of administrative procedures,
which occur in various areas of the Russian Federation;
It should be remembered that some administrative procedures are regulated solely
by the federal legislation, and the in some regions authorities are not empowered
to introduce their own measures of regulation. This case brings up a need to analyse
how the law is enforced in such regions. At the same time, the difference in applying
norms and regulations of the federal legislation can lead both to inconsistency
of the regional legislation with the federal one and incompliance with the legislation
imposed by no standard basis. Frequently this is due to adopting intra-agency
acts contradictory both to the federal and regional legislations. Despite the
obvious inadmissibility of such practice, such incidents are are possible in theory,
when similar norms and regulations are brought into effect in favour of entrepreneurs,
correcting the faults in the federal and regional legislations along the way.
Some procedures allow regional authorities to introduce their own legislative
norms, and such procedures have to be analysed first.
Within the framework of this Project Component, the analysis of legislative and
legal foundation of the regional and municipal levels, which regulate the red
tape, will be carried out.
The findings of the research of administrative barriers will be used in the regions
in question. For instance, Small Enterprises Development Support. SMERUS 9803the
following reports were produced within the Small Enterprises Development Support.
