Building Permits and Land Use Permits

Purchase a land plot under construction procedure, which is regulated by the federal and local legislation, is one of the most complicated and intricate today. If this procedure is not simplified it will be hard to count on significant investments into construction. Various amendments of the legislation in this sector should be made, below are the following points that affect the position of entrepreneurs:
  • introducing mainly tenders for land parcels - estate property, granting land parcels following the procedure of preliminary agreement on site location only in exclusive cases stipulated by the Law;
  • setting out clear terms for processing the documents and agreements in various instances, introducing the 'single window' principle in the relationship between entrepreneurs and authorities;
  • placing a ban on voluntary unnecessary "investments" by the entrepreneurs receiving land plots;
Both the sale procedure of land under construction and the procedure for obtaining planning permission require harmonization and simplification in order to attract investment. The following courses of actions to amend the legislation have been taken:
  • coordinating the legislation regulating project documentation, control and supervision of construction with the technical regulation legislation;
  • excluding from the legislation the clauses stipulating compulsory expertise for construction project documentation for specified types of building sites;;
  • introducing alternative state methods that will ensure health and safety of buildings and structures;
  • defining responsibility of numerous members of construction process for their actions in regards of health and safety;
  • simplifying the procedure for obtaining planning/ construction permissions regulated by the regional legislative and legal acts of subjects of the Russian Federation for majority of sites.
